Ordinary and Lasting Powers of Attorney (LPAs)

A Power of Attorney is when a person (the Donor) authorises another person (the Attorney) to act on their behalf and gives the Attorney(s) certain legal powers to act on the Donor's behalf. It is important to know the difference between these two main types of Powers of Attorney.

You might set up a Power of Attorney to allow a friend to sell your house for you while you are working abroad, or set up a Lasting Powers of Attorney to allow trusted relatives to manage your affairs if you become ill in later years. There are two types of Ordinary Powers of Attorney:
General Power of Attorney - this covers every action that might require a signature.
Specific Power of Attorney - this is limited to a single action i.e. selling a property.

If the Donor later lacks capacity to manage his or her affairs, then the Ordinary Power of Attorney becomes invalid. However, it might be helpful to seek medical advice regarding the mental capacity of the Donor at the time the Power of Attorney is given.

Lasting powers of attorney arranged at a fixed fee

A Lasting Power of Attorney (LPA) is a legal document which allows the person of your choice the power to manage your financial affairs and/or medical and welfare decisions in the event of mental incapacity, and therefore does not become invalid on mental incapacity.
